These terms and conditions contain legal obligations and we encourage you to read through them carefully. Unless otherwise stated, any purchases made through boutiquetraveler.com, our distributors, and our affiliates are subject to these terms and conditions.

1. OUR CONTRACT

All bookings are made with BOUTIQUE TRAVELER LLC. By making a booking, the guest (you) is deemed to have agreed to these terms and conditions on behalf of all individuals included in the booking. The services to be provided are those in your booking confirmation invoice. No alterations or variations to these terms and conditions are in effect unless made in writing by and under the authority of BOUTIQUE TRAVELER LLC.

2. PRICING & PAYMENTS

2.1. Pricing

a) Prices are correct at the time of quoting, converted at the prevailing foreign-exchange rate as set by our payment exchange. The exchange rate will vary on a daily basis in line with international currency movements.

b) Prices appearing on the website are the current rates and can change without notice. Once a guest has booked a tour, the guest will not be required to pay any difference in the event of a price increase. BOUTIQUE TRAVELER LLC will not refund the balance of any price reduction.

c) Prices quoted include all inclusions as indicated on the tour description on boutiquetraveler.com.

d) Prices do not include:

Tips and gratuities — If you are happy with the services provided by your local guides and drivers, a tip of 10 – 20% — though not compulsory — is appropriate. While it may not be customary to you, it is of great significance to the people who will take care of you during your travels, inspires excellent service. Please consider this when budgeting for your extra expenses on your tour.

Items of a personal nature — These may include snacks, meals, and drinks not outlined as an inclusion in the inclusions section of the tour description.

Baggage and personal insurance — It is highly recommended that each guest obtains adequate insurance for their travels to cover: your personal effects, medical, cancellations, and amendments for any reason.

2.2. Payment

a) The following credit cards are accepted for payment: Visa, MasterCard, American Express, JCB, Discover, and Diners Club.

b) Credit card service fee — BOUTIQUE TRAVELER LLC does not charge guests a service fee on credit card payments.

c) Payment due — Full payment is required at the time of booking.

3. CANCELLATIONS/NO-SHOWS & AMENDMENTS TO BOOKINGS

3.1. Cancellations by the guest

a) Cancellation fees – Cancellation fees may apply to any cancellations by the guest of a service provided by BOUTIQUE TRAVELER LLC. Unless otherwise specified, the cancellation policy is as follows:

Cancellations made more than 48 hours prior to travel receive a full refund;
Cancellations made 48 hours or less prior to travel are non-refundable, and no refund will be issued. For your protection in the case of an unforeseen event, we strongly recommend purchasing travel insurance.

NOTE: Corporate/Group cancellation is non-refundable inside 2 weeks prior to travel.

b) Unused portions of tours – No refund is provided for any unused portion of a tour, including the entire tour in the event a guest does not commence at the designated start point of the tour.

3.2. Cancellations by BOUTIQUE TRAVELER

We may cancel a tour at any time prior to departure if, due to terrorism, natural disasters, political instability, or other external events it is not viable for us to operate the planned itinerary. If we cancel your tour, you can transfer amounts paid to an alternate departure date or, alternatively, receive a full refund. In circumstances where the cancellation is due to external events outside our reasonable control, refunds will be less any unrecoverable costs. We are not responsible for any incidental expenses you may have incurred as a result of your booking, including but not limited to visas, vaccinations, travel insurance, or non-refundable flights.

3.3 Amendments to bookings by the guest

a) Guests wishing to amend an existing booking must provide at least 48 hours notice by phone or email. Prices applying to the new booking will be the price at the time the new booking is made, based on availability. Cancellation charges may apply if amended within 48 hours of travel. For your protection in the case of an unforeseen event, we strongly recommend purchasing travel insurance.

3.4. Amendments to itineraries BOUTIQUE TRAVELER

While we endeavor to operate all tours as described, we reserve the right to change the tour itinerary. The itinerary provided for each experience is representative of the activities planned; however, the route, amenities, stops, and modes of transport may be subject to change without prior notice due to local circumstances or events. If we make a major change before departure, we will inform you as soon as reasonably possible. We reserve the right to change an itinerary after departure due to local circumstances or events outside of our control.

3.5. Weather Policy

While quite unlikely, all tours will still proceed in the event of rain. If it looks like rain, please be sure to dress appropriately and ask your hotel reception for an umbrella. BOUTIQUE TRAVELER LLC may choose to cancel a tour should the weather conditions be deemed unsafe to operate in (eg. torrential rain, electrical storms, extreme winds, flooding etc). In this event, we will work closely with affected guests to reschedule them for a suitable date and time. If unable to reschedule, BOUTIQUE TRAVELER LLC will provide a credit or full refund at the guest’s request.

4. Confirmation

Upon receipt of full payment, BOUTIQUE TRAVELER LLC will send a confirmation via email for the booked tour. This will contain all important information required including:

a) Meeting and ending locations
b) Date and time of tour
c) What to wear/bring
d) What’s included
e) What’s not included
f) Guide contact info
g) Any additional information

We may also send you other relevant information about the city to help you plan your stay.

5. The Tour Experience

5.1. Timeliness

Guests must adhere to the start time set out in the confirmation email. In the event the guests are not at the designated starting point within 15 minutes of the start time provided, the guide will attempt to contact the lead guest. If no contact can be made, the guide will consider the guest to be a “no show” and the tour will be canceled and no refund will be provided.

Meeting point — It is recommended that you arrive at least 10 – 15 minutes prior to the start of the tour.

5.2. Your responsibility

The guest making the booking is responsible for their own and their party’s actions. If the guide deems you or your party’s actions to cause danger to other guests or our staff, or to be offensive to the local community and culture, we reserve the right to remove you from the tour immediately. No refund will be supplied. You must at all times comply with the laws, customs, and you also agree to travel in accordance with our guidelines.

5.3. Acceptance of risk

You acknowledge that your tour may involve a degree of personal risk. Your decision to travel is made in light of consideration of this information and you accept that you are aware of the personal risks attendant upon such travel.

6. Information accuracy

6.1. Your responsibility

The lead guest is responsible for providing accurate information during the booking process. BOUTIQUE TRAVELER LLC reserves the right to cancel any bookings if inaccurate information is provided, including (but not exclusive to):

i) Guest name(s)
ii) Hotel (meeting point) details
iii) Email address
iv) Phone number
v) Date/time booked
vi) Special requests

6.2. Website

We cannot be responsible for any delays or interruptions to boutiquetraveler.com. We will use commercially reasonable efforts to minimize delays and interruptions. However, we cannot warrant that the website will be available at all times or at any given time.

We may at any time and without notice to you, discontinue the website in whole or in part. However, we cannot be responsible for any loss, cost, damage or liability that may result from our discontinuance of the website.

7. Age and health requirements

7.1. Age requirements

All guests under the age of 18 must be accompanied by a legal guardian, or in lieu of a legal guardian, by an escort over the age of 18, appointed by their legal guardian. The legal guardian or their designee will be responsible for the guest under the age of 18. While many of our tours permit all ages, the minimum age requirements may vary with tours. Please see the tour description on boutiquetraveler.com to check whether a tour is child-friendly. For tours featuring alcohol, guests will be required to show proof of age.

7.2. Health requirements

Some of our tours can be physically demanding and guests must ensure that they are suitably fit to allow participation. We are able to provide details on mandatory health requirements; however, we are not medical experts. It is your responsibility to ensure that you are physically fit to participate. All our tours specify a physical rating, which is to be used as a guideline for gauging whether a tour is appropriate for your fitness level.

8. Travel insurance

It is a requirement that all guests taking a tour have valid and comprehensive travel insurance. BOUTIQUE TRAVELER LLC cannot be held responsible for any liability, expenses, or losses you incur as a result of being inadequately insured. We strongly recommend that at the time of booking a comprehensive travel insurance policy is purchased.

9. Photos and marketing

During your tour, the guide will be taking photos of you (and your group). Edited images taken on your tour will be available for download through a private link (see privacy below) on the boutiquetraveler.com. This link will be sent to the email the used to make the booking, 5 days (or less) after the completion of your tour.

10. Terms of use

a) By using boutiquetraveler.com, our distributors, and/or affiliates, the guest agrees to be bound by the conditions outlined in these terms and conditions.

b) By engaging with BOUTIQUE TRAVELER LLC, the guest agrees to do so for lawful purposes only.

c) When engaging with BOUTIQUE TRAVELER LLC, the guest agrees to do so for personal purposes and not for their own personal commercial gain and will not enter into or provide fraudulent requests or information to our partners, affiliates, on boutiquetraveler.com or to any of our representatives.

11. Privacy policy

What is personal data?

We collect information about you in a range of forms, including personal data. As used in this Policy, “personal data” is as defined in the General Data Protection Regulation 2018 and any successor legislation, this includes any information which, either alone or in combination with other information we hold about you, identifies you as an individual, including, for example, your name, postal address, email address and telephone number.

Why do we need your personal data?

We will only process your personal data in accordance with applicable data protection and privacy laws. We need certain personal data in order to provide you with access to our Site and Services. If you do not agree to our use of your personal data in line with this Policy, please do not use our Site and Services.

11.1. Collecting your Personal Information

We collect aggregate information on what pages consumers access or visit, information volunteered by the consumers, such as booking information, survey information, newsletter subscriptions, and giveaway entries.

Any personal information that we collect about you may be used for any purpose associated with the operation of your experience or to send you marketing material in relation to special offers or in the event of a new tour location becoming available. Your information may be disclosed to our booking agents, service providers, or other suppliers to enable us to operate your tour only. We do not, and will never, distribute your personal information to any third-party for any other reason.

We collect information about you in the following ways:

a) Information you give us

This includes:

  • the personal data you provide us when you book a tour on boutiquetraveler.com or any third-party booking site, including your name, email address, phone number, special requests,
  • the personal data you provide in follow up surveys, including, the country you live in, how you heard about us, whether it is a first-time visit to the city, any special occasions,
  • the personal data you provide us when you enter our tour giveaway, including your name, email address, the country you live in,
  • the personal data you provide when you correspond with us by phone, email or otherwise.

b) Information automatically collected

We automatically log information about you and your computer or mobile device when you access boutiquetraveler.com. For example, when visiting boutiquetraveler.com, we log your computer or mobile device operating system name and version, manufacturer and model, browser type, browser language, screen resolution, the website you visited before browsing to boutiquetraveler.com, pages you viewed, how long you spent on a page, access times and information about your use of and actions on boutiquetraveler.com. We collect this information about you using cookies (see below).

i) Cookies

We may collect information using “cookies.” Cookies are small data files stored on the hard drive of your computer or mobile device by a website. We may use both session cookies (which expire once you close your web browser) and persistent cookies (which stay on your computer or mobile device until you delete them) to provide you with a more personal and interactive experience on boutiquetraveler.com.

We may also use pixel tags (which are also known as web beacons and clear GIFs) on our Site and Services to track the actions of users on boutiquetraveler.com. Unlike cookies, which are stored on the hard drive of your computer or mobile device by a website, pixel tags are embedded invisibly on web pages. Pixel tags measure the success of our marketing campaigns and compile statistics about usage of boutiquetraveler.com so that we can manage our content more effectively. The information we collect using pixel tags is not linked to our users’ personal data.

11.2. Images and Licencing

We may use any images of you taken during the tour for advertising and promotional purposes in any medium we choose. Your participation in a BOUTIQUE TRAVELER LLC tour grants us a perpetual, royalty-free, worldwide, irrevocable license to use such images for publicity and promotional purposes.

NOTE: We understand and appreciate any privacy concerns. If you prefer that we do not share your images, you must advise your guide at the commencement of the tour.

At the completion of your tour, your photos will be available through a private link on our website. This link can only be reached through the direct link (URL) provided in an email to you. It is your responsibility not to share this link publicly should you wish for your photos to remain private. We cannot be held responsible for the privacy of your photos in the case you share this URL by any means.

11.3. User-Generated Content

BOUTIQUE TRAVELER LLC takes no responsibility and assumes no liability for any content posted by you on boutiquetraveler.com or any third party sites. This includes reviews, comments, and any other user-generated content you post.

11.4. Access to your information

Upon request, we provide site visitors with access to unique identifier information that we maintain about them (e.g. dates on which customers made purchases, amounts and types of purchases, contact info – name, phone number, email, tours taken, survey answers). Consumers can request access to this information by emailing us at [email protected].

11.5. International Data Transfer

Your information, including personal data that we collect from you, may be transferred to, stored at and processed by us and our affiliates and other third parties outside the country in which you reside, including, but not limited to the United States, where data protection and privacy regulations may not offer the same level of protection as in other parts of the world. By using boutiquetraveler.com or any third-party booking site, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Policy.

11.6. Security

We seek to use reasonable organizational, technical and administrative measures to protect personal data within our organization. Unfortunately, no transmission or storage system can be guaranteed to be completely secure, and transmission of information via the internet is not completely secure. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you might have with us has been compromised), please immediately notify us of the problem by contacting us at [email protected].

11.7. Opt-out

At any time, you may ask us to stop sending you marketing messages by following the opt-out links on any email sent to you or by contacting us at any time. Where you opt out of receiving these marketing messages, this will not apply to personal data provided to us as a result of a product/service purchase, product/service experience or other transactions.

11.8. Erase and Forget

In certain situations, for example, when the information we hold about you is no longer relevant or is incorrect, you can request that we erase your data.

13. Disclaimers and limitations of liability

a) BOUTIQUE TRAVELER LLC, our partners, affiliates, and distributors shall not be liable for injury, damage, loss, accident, delay, or irregularity, liability, or expense to person or property.

b) BOUTIQUE TRAVELER LLC, our partners, affiliates, and distributors accept no responsibility for any sickness, acts of crime, labor disputes, government actions, acts of war and/or terrorism, weather conditions, defect in any vehicle of transportation, or for any misadventure or casualty or any other causes beyond their control.

c) BOUTIQUE TRAVELER LLC maintains information that is accurate to the best of our knowledge; however, does not warrant that content and information provided on boutiquetraveler.com or via any of our affiliate sites or via distributors will be without error and that functionality of the websites uninterrupted or without error.

d) BOUTIQUE TRAVELER LLC will not accept responsibility or liability for any guest who contravenes any law or regulation.

e) This agreement is governed by the laws of California, United States.

14. Indemnification

You agree to defend and indemnify BOUTIQUE TRAVELER LLC, our partners, our affiliates, and distributors, and any of their officers, directors, employees, and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties, or other costs or expenses of any kind or nature, including but not limited to reasonable legal and accounting fees brought by third parties as a result of:

a) Your breach of this agreement or documents referenced in this Agreement;

b) Your violation of any law or the rights of a third party; and/or

c) Your use of this website or any of BOUTIQUE TRAVELER LLC’s affiliate websites.

15. Severability

In the event that any term or condition contained here is unenforceable or void by operation of law or as being against public policy or for any other reason, then such term or condition shall be deemed to be severed from this contract or amended accordingly only to such extent necessary to allow all remaining terms and conditions to survive and continue as binding.

16. Intellectual Property

The material on boutiquetraveler.com, including the software, design, text, images, and graphics comprised in the Website and the selection and layout of the website are owned or under license by BOUTIQUE TRAVELER LLC and protected by California and international laws.

Your use of the website does not grant you a license or act as a right of use of any of the trademarks or logos, whether registered or unregistered, that are displayed on the website without the express written permission of the trademark owner.

We own the copyright, which subsists in all creative and literary works that are displayed on the website.

You may view the website and its contents using your web browser. In visiting the website, you may make a temporary copy of the website by means of the usual operation of your web browser only.

You must not:

Reproduce or use any of the material on the website for commercial purposes, including sale; in any way modify the material on the website; or cause any of the material on the website to be framed or embedded on another website.

In summary, you must not modify, copy, reproduce, republish, frame, upload to a third party, post, transmit or distribute the content of the website in any way except as expressly provided for by us or expressly authorized in writing by us.

In the event that you do any of the above acts, we will not hesitate to enforce our intellectual property rights against you.
